TERMS OF SERVICE (TOS)

This Terms of Service agreement (the "TOS") is a legally binding contract between you (the "User") and Maxion Game (the "Company").

This TOS governs your access to and use of the game MU MAX Age, related websites, software, and services (collectively, the "Service") operated by the Company.

By accessing or using the Service, you agree to be legally bound by these TOS. If you do not agree to these terms, you must not access or use the Service.

1. Definitions

  • "Service" means MU MAX Age and all related software, systems, and services.
  • "Account" means a registered user account required to access the Service.
  • "Virtual Items" means in-game currency, items, skins, NFTs, or digital content.
  • "User Content" means any content submitted by users.

2. License Grant and Restrictions

2.1 License: The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use.
2.2 Restrictions: You may not:
  • Reverse engineer, decompile, or modify the Service.
  • Sell, lease, or exploit the Service commercially.
  • Create derivative works.
  • Use unauthorized software, bots, or automation.
  • Create unauthorized connections or servers.
  • Infringe intellectual property rights.

Violation of restrictions above may result in immediate termination.

2.3 Third-Party Platforms: If you access the Service via a third-party platform (e.g., Apple App Store, Google Play, Steam), you acknowledge that these TOS are between you and the Company, not the third-party platform. The platform provider has no obligation to furnish maintenance or support for the Service.

3. Accounts, Access, and Age Requirements

  • Age Requirement: You must be at least 13 years old (or the minimum age of digital consent in your country) to create an Account. If you are a minor, your parent or legal guardian must review and agree to these TOS on your behalf.
  • All Accounts remain the property of the Company.
  • You are responsible for account security.
  • The Company may suspend, restrict, or terminate Accounts at its sole discretion for: violations, inactivity, fraud or abuse, or operational reasons.
  • You have no ownership rights in your Account.

4. Ownership, Virtual Items, and Game Balancing

4.1 Intellectual Property: All rights in the Service belong to the Company or its licensors.
4.2 Virtual Items & Game Balancing

Virtual Items have no real-world monetary value and do not constitute property or ownership rights.

Game Balancing: The Company reserves the right to manage, regulate, control, modify, "nerf," "buff," or eliminate Virtual Items (including altering stats, appearance, or functionality for gameplay balance) at any time, at its sole discretion, without liability to you.

4.3 Third-Party Trading and Restrictions: You may not buy, sell, trade, transfer, or otherwise exchange Virtual Items outside of channels expressly authorized by the Company.

For the avoidance of doubt, trading Virtual Items through the Maxion Marketplace as described in Section 20 is permitted as an authorized exception. However, the Maxion Marketplace is operated by independent third-party providers and is not owned, operated, or controlled by the Company.

Any transactions conducted through the Maxion Marketplace or any other third-party service are solely between you and the applicable third party, and are governed by such third party's terms and conditions.

The Company is not responsible for, and disclaims all liability arising from, any loss, damage, or disputes resulting from such transactions.

5. Rules of Conduct

Users must not:

  • Use offensive, illegal, or misleading language.
  • Harass or disrupt other users.
  • Spam or flood communication channels.
  • Engage in gambling activities.
  • Engage in fraud or illegal activity.
  • Use cheats, bots, or unauthorized software.
  • Exploit bugs or vulnerabilities.

Enforcement: Penalties may include temporary suspension, permanent ban, or legal action. The Company enforces rules at its sole discretion.

6. Anti-Cheat and System Integrity

You may not modify game data, intercept network traffic, or use automation tools. Violations may result in permanent suspension and legal action. The Company reserves the right to monitor your device's memory and background processes while you are using the Service to detect cheating and enforce compliance.

7. Blockchain and Digital Assets

7.1 General and Definitions: Certain features of the Service may involve blockchain-based digital assets, including Non-Fungible Tokens (NFTs), cryptocurrencies, and in-game tokens (collectively, "Digital Assets"). These Digital Assets may exist on external blockchain networks, such as the BNB Smart Chain or Maxi Chain, and may be issued, managed, transferred, and stored through third-party platforms, protocols, and service providers (including, without limitation, blockchain networks, digital wallets, and marketplaces) that are not owned, operated, or controlled by the Company.

The Company does not create, custody, control, or have access to users' Digital Assets or private keys, and has no ability to recover, transfer, or reverse any transactions involving Digital Assets.

7.2 No Investment Representation: Digital Assets are provided solely for entertainment and gameplay purposes. They are not financial products, securities, or investments. The Company makes no guarantees or representations regarding the value, stability, transferability, or continued availability of any Digital Assets. You acknowledge that Digital Assets are highly volatile and may lose all or substantially all of their value.
7.3 Assumption of Technological Risks: By utilizing Digital Assets within the Service, you acknowledge and accept the inherent risks associated with blockchain technology and third-party services, including but not limited to:
  • Smart Contract Vulnerabilities: The underlying code of smart contracts may contain bugs, flaws, or vulnerabilities that could result in the loss or compromise of Digital Assets.
  • Irreversible Transactions: Blockchain transactions are irreversible. The Company cannot cancel, reverse, or modify any transaction once submitted to the blockchain.
  • Network Disruptions, Forks, or Failures: Blockchain networks may experience congestion, downtime, forks, or other changes that may affect the functionality, availability, or value of Digital Assets.
  • Third-Party Service Failures: Digital wallets, marketplaces, and other third-party services may malfunction, be compromised, or become unavailable, and the Company is not responsible for any resulting loss.
  • Phishing and Security Risks: You are solely responsible for maintaining the security of your wallet, private keys, and credentials, and for ensuring that you interact only with legitimate and authorized platforms.
7.4 Regulatory and Tax Risks: The legal and tax landscape for blockchain technology is uncertain and constantly evolving. You are solely responsible for determining what, if any, taxes apply to your Digital Asset transactions. New regulations may negatively impact the Service or the value of your Digital Assets, and the Company is not liable for such impacts.
7.5 No Intellectual Property Ownership: Ownership of a Digital Asset, including an NFT, does not grant you any ownership of intellectual property rights in the associated content, including but not limited to copyrights, trademarks, or other proprietary rights, except for a limited, non-exclusive, non-transferable license to use such content solely within the Service, subject to these Terms.
7.6 Limitation of Liability for Blockchain Services: To the maximum extent permitted by applicable law, the Company shall not be liable for any loss, damage, or disruption arising out of or in connection with: (a) the use of or inability to use Digital Assets; (b) any blockchain network, smart contract, or protocol; (c) any third-party wallet, exchange, or marketplace; or (d) user errors, including incorrect wallet addresses, lost private keys, or unauthorized transactions.

All interactions with Digital Assets and related third-party services are undertaken at your own risk.

8. Payments and Refund Policy

  • All purchases are final and non-refundable, except where required by law.
  • Third-Party Payments: Payments made through third-party gateways (e.g., App Stores, crypto wallets) are subject to their respective terms. The Company is not responsible for errors made by payment processors.
  • If a refund is issued, related Virtual Items may be revoked.
  • Chargeback abuse may result in account termination.
  • You are responsible for all applicable taxes.

9. User Content and Copyright Policy

You grant the Company a worldwide, perpetual, royalty-free license to use your User Content.

You must not submit content that violates laws, infringes rights, or contains malicious material. The Company may remove content at its discretion.

Copyright Infringement: If you believe your copyrighted work has been infringed upon within the Service, please contact our support desk with a formal takedown notice, including a description of the work, its location, and your contact information.

10. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated by reference.

11. Health and Safety Warning

Certain users may experience seizures from visual stimuli. Discontinue use if symptoms occur and consult a doctor.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." The Company does not guarantee uninterrupted service, error-free operation, security, or reliability. Use is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for indirect or consequential damages. Total liability shall not exceed the amount paid in the last 6 months.

14. Force Majeure

The Company is not liable for delays or failures caused by events beyond its control, including natural disasters, war, internet outages, or blockchain failures.

15. Service Updates and Changes

The Company may update or modify the Service, install patches automatically, or discontinue features. Continued use constitutes acceptance.

16. Termination

The Company may terminate access at any time without prior notice or liability. Upon termination, your license ends immediately, and access to Virtual Items may be revoked without compensation.

17. Governing Law and Dispute Resolution

This TOS shall be governed by the laws of Thailand. All disputes shall be resolved by binding arbitration:

  • Arbitration body: SIAC
  • Location: Singapore
  • Language: English
  • You waive the right to jury trials and class actions. Claims must be filed within 1 year.

18. Service Availability

The Service is provided on an 'as is' basis without any uptime guarantees. The Company reserves the right to interrupt, throttle, modify, or suspend access to the Service at any time, for any reason, without prior notice or liability. Furthermore, the Company makes no representations that the Service is appropriate or available for use in all locations.

19. General Provisions

  • Severability: Invalid provisions do not affect others.
  • Entire Agreement: This TOS supersedes prior agreements.
  • No Waiver: Failure to enforce is not a waiver.
  • Assignment: The Company may assign rights freely.

20. Maxion Marketplace (Third-Party Service)

The Service may reference or provide access to the Maxion Marketplace, a blockchain-powered peer-to-peer (P2P) marketplace that enables players to trade in-game items. The Maxion Marketplace is operated by independent third-party providers and is not owned, operated, or controlled by the Company.

Your use of the Maxion Marketplace is entirely optional and is not required to access or enjoy the core features of the Service. Any transactions, interactions, or activities conducted through the Maxion Marketplace are solely between you and the applicable third party, and are governed by such third party's terms and policies.

The Company is not responsible for the operation, availability, security, or performance of the Maxion Marketplace, and disclaims all liability arising from or related to your use of, or inability to use, the Maxion Marketplace or any transactions conducted therein.
